The Website enables employers (“Employers”) to:

• Post job listings (“Job Posts”).
• Submit Job Posts for analysis by third-party AI providers (e.g., OpenAI, Anthropic, Gemini).
• Share AI-generated links for candidate applications.
• Track applicants via the built-in Applicant Tracking System (ATS).

3. User Obligations

3.1 Eligibility

Users must be at least 18 years old.

3.2 Prohibited Conduct

You agree not to:

• Post Job Posts containing illegal, discriminatory, fraudulent, or defamatory content.
• Harass candidates, Employers, or other users.
• Reverse-engineer, scrape, or exploit the Website’s code or data.
• Violate third-party intellectual property rights.
• Share login credentials or misuse the ATS.

4. Subscription and Payments

4.1 Subscription Plans

Three (3) packages are available with limits on:

• Number of Job Posts.
• AI-analyzed applicant responses.

Exceeding limits allows visibility of additional applicants, but AI analysis requires pay-as-you-go fees.

4.2 Payment Processing

Payments are processed via third-party providers (e.g., Stripe). Fees are non-refundable unless required by law.

5. Intellectual Property

5.1 Ownership

All content on the Website (Job Posts, applicant data, AI outputs) is owned by vkncy Inc.

5.2 License

By posting content, you grant vkncy Inc. a worldwide, royalty-free license to use, modify, and display it for service delivery.

6. Disclaimers

6.1 No Warranties

The Website and AI analysis are provided “as-is.” We do not guarantee accuracy, completeness, or hiring outcomes.

6.2 Limitation of Liability

We are not liable for:

• Damages from use of the Website.
• Hiring decisions or candidate interactions.
• Third-party AI errors or omissions.

7. Termination

We may suspend or terminate access for violations of these Terms.

8. Governing Law & Dispute Resolution

8.1 Jurisdiction

These Terms are governed by Delaware law.

8.2 Arbitration

Disputes will be resolved through binding arbitration under AAA or JAMS rules, conducted in Delaware.

9. Amendments

We may update these Terms. Continued use after changes constitutes acceptance.
